These Terms and Conditions govern the use of the iuliastration.com website and the purchase, license, download, and use of our digital art products and merchandise (collectively, the "Products"). By using our website and purchasing, licensing, downloading, or using our Products, you agree to be bound by these Terms and Conditions and Privacy Policy.

Our website may also provide links to other websites or resources, which are not under our control. We are not responsible for the availability of these external sites or resources, and we do not endorse or accept liability for any content, advertising, products, services, or other materials available on or through such sites or resources.

ARTWORK, LICENSE AND USE

You may use our website and purchase our Products only if you are of sound mind and for your personal use.

For artwork in physical form, such as art prints, the successful completion of your order and payment on iuliastration.com grants you a non-exclusive, worldwide, and indefinite license to use, exhibit, sell, and rent the artwork.

For downloadable products, your purchase of a product grants you a non-exclusive, non-sublicensable, non-transferable license to download and access the product for your personal use and reference, and to print or convert the product to an image or vector format for your own storage and retention.

You agree not to copy, resell, sublicense, rent, share, or otherwise distribute any of our products to any third party. You also agree not to use any of our products in a way that might be detrimental to us or damage our reputation.

We do not currently offer an extended license for the use of our products on websites, collaterals, brochures, advertisements, screen savers, wallpapers, software, e-cards, e-mails, e-books, presentations, templates, movies, videos, TV advertisements, unofficial logos, items for resale and free distribution, or for any other commercial or non-commercial use.

INTELLECTUAL PROPERTY

You are hereby granted a limited royalty-free personal license to view the content on the Site on your personal computer or other internet-compatible device. Unless otherwise provided through any other applicable terms and conditions to which you agree, including Terms and Conditions, for image licenses, no portion of the Site, Services or Site Information may be reprinted, republished, modified, or distributed in any form without iuliastration.com express written permission. You may not, and these Terms do not give you permission to, reproduce, reverse engineer, decompile, disassemble, modify, transmit, sell, distribute, license or create derivative works with respect to the Site Services or any of the Site Information.

The products, whether modified or not, and all intellectual property and copyright contained therein, are and shall at all times remain our sole and exclusive property. You agree that under no circumstances, whether the product has been modified or not, shall you have or attempt to claim ownership of any intellectual property rights or copyright in the product.

Further, You are hereby granted a non-exclusive royalty for a personal license for the purchase of all artwork on iuliastration.com to use, to exhibit (unlimited), to sell and to rent the artwork with a worldwide, timely indefinitely license right.

PRICE, TAX AND PAYMENT

The prices displayed on iuliastration.com are in USD (US Dollar) and are subject to change at our sole discretion. The license for the product is included in the final price.

Discount codes must be applied prior to completing your purchase on iuliastration.com. They must be entered in the discount code field on the shopping cart page to be applied. Discount codes only apply to the value of the order and do not include shipping costs or other charges, unless otherwise stated. Only one discount code can be applied per order and codes cannot be combined. Expired discount codes are no longer valid after their expiration date. Discount codes cannot be applied retroactively to orders that have already been completed.

Please note that in some countries, such as Switzerland, additional taxes, duties and fees may apply, which are determined by the carrier depending on various factors including amount threshold. These taxes, duties, and fees are the sole responsibility of the customer.

All payments for our Products must be made through the methods provided on our website. We reserve the right to change the available methods of payment at any time.

You agree that under no circumstances whatsoever shall you initiate any chargebacks via your payment provider. You agree that any payments made by you for any of our products are final and may not be charged back.

SHIPPING AND TRACKING

Once your order is confirmed, it is final and cannot be edited or canceled. We will make every effort to accommodate any changes to your shipping address, but we are not obligated to do so. All physical products, including art prints, are automatically processed, manufactured, and shipped on your specific demand on iuliastration.com.

Your order will typically be shipped within 5 business days, and you will receive a shipping notification email with a tracking link. We advise regularly checking the tracking data for your shipment, as the tracking data is considered notification and the carrier may not leave additional notices in the case of unsuccessful delivery attempts. It is your responsibility to monitor the shipment and delivery of your order, and to contact the carrier, logistics partner, or local post office to ensure delivery and collection of your order. Use always the provided tracking code to identify your shipment.

Please note that we currently only support PO Box delivery to the United States of America. For all other destination countries, a full and valid address is required. If you provide an incorrect or insufficient address, or an address that does not match the name on your mailbox, the shipment may be lost. It is your sole responsibility to provide a correct address.

Shipments that are unclaimed may be lost. It is your responsibility to claim your shipment in a timely manner. If the package is lost in transit, all claims must be submitted no later than 14 days after the estimated delivery date according to the tracking link provided in the tracking email notification. It is your obligation to follow-up your delivery with the provided tracking email and tracking code and engage directly with the logistics provider/carrier to enable and monitor a successful delivery to your destination address.

In all other cases, the risk of loss and damage of your delivery pass to you upon our delivery to the carrier. It shall be your responsibility to file any claim with the carrier.

DAMAGE AND RETURN POLICY

All sales are final. We do not accept returns on any of our products and we do not offer reshipment of any products that have been lost or undelivered due to incorrect or insufficient address provided by the customer, unclaimed shipments, or any other reasons beyond our control. It is the responsibility of the customer to provide a correct and valid shipping address, monitor the shipment and delivery status and claim the package in a timely manner. We encourage our customers to double check the shipping information before placing their orders to prevent any potential issues with delivery. In case of any problems with the delivery, we suggest you to contact the carrier or logistics provider directly using the provided tracking information and file a claim if necessary. All returned items are recycled or disposed.

In case of a damaged or defective product, please contact us at shop(at)iuliastration.com within 14 days of receiving your order and we will do our best to resolve the issue. In case of a defective product, we require photo evidence of the damage and the packaging. After this period, any complaints will no longer be considered.

While we strive to represent colors accurately on our website, we cannot guarantee that the colors you see on your screen will exactly match the colors of the final printed product. This is due to the differences in the color representation between electronic displays and printing technologies, as well as individual screen settings and variations in printing conditions among others. Color deviations are no damage claim.

We encourage our customers to carefully review their orders before placing them to avoid any misunderstandings and encourage you to ensure the accuracy of the provided shipping information to prevent any potential issues with delivery.

MARKETING AND COMMUNICATION

We offer the option to subscribe to our email campaign, newsletter, news, and offers on iuliastration.com. By subscribing, you will receive updates on our latest products, announcements, discount codes, and more. Your subscription must be verified through an email confirmation. If you do not verify your email address, you will not receive any email communications. You can unsubscribe at any time by clicking the unsubscribe link in any of our emails or by sending an email to shop(at)iuliastration.com. We only collect your email address for the purpose of sending you our email campaign, newsletter, news, and offers. Once you unsubscribe, you will be removed from our email list until you choose to resubscribe.

By submitting any questions, comments, suggestions, ideas, feedback, or other information to us through our contact form or other means (collectively, "Submissions"), you acknowledge and agree that your Submissions are non-confidential and become our sole property. We have the exclusive right to use and disseminate these Submissions for any lawful purpose without acknowledging or compensating you.

You waive any moral rights to your Submissions, and warrant that they are original or that you have the right to submit them. We shall not be held liable for any alleged or actual infringement or misappropriation of proprietary rights in your Submissions.

DISCLAIMER OF WARRANTIES

We take no responsibility for the accuracy, quality, completeness, timeliness or similar content and data on Iuliastration.com. Any liability on the part Iuliastration.com is excluded and limited to the statutory minimum. The disclaimer and limitation of liability shall also cover any possible personal liability of its officers, employees and auxiliary persons of Iuliastration.com. The user agrees to indemnify Iuliastration.com and its officers, employees and assistants from any liability and all costs if Iuliastration.com and its officers, employees and auxiliary persons, for whatever legal reasons relating to Iuliastration.com is prosecuted related to a user's activities of other users or third parties. The user also undertakes to support Iuliastration.com in connection with the assertion of claims against third parties or against other users.

We make every effort to ensure that our products are accurate, authoritative and fit for the use of our customers. However, we take no responsibility whatsoever for the suitability of the product, and we provide no warranties as to the function or use of the product, whether express, implied or statutory, including without limitation any warranties of merchantability or fitness for particular purpose. You agree to indemnify us against all liabilities, claims, demands, expenses, actions, costs, damages, or loss arising out of your breach of these terms and conditions. We do not warrant that the functions contained in the website or the Products will be uninterrupted or error-free, that defects will be corrected, or that the website or the servers that make the website available are free of viruses or other harmful components.

LIMITATION OF LIABILITY

In no event shall we be liable for any damages of any kind, including, but not limited to, direct, indirect, incidental, punitive, and consequential damages, arising out of or in connection with the use of our website or the purchase, license, download, or use of our Products.

Our total liability to you for any and all damages, losses, and causes of action, whether in contract, tort, or otherwise, shall not exceed the amount paid by you for the Products.

GOVERNING LAW AND JURISDICATION

Swiss law is exclusively applicable. The exclusive place of jurisdiction for all disputes shall be the courts of Zug. You agree that any legal action or proceeding between you and iuliastration.com shall be brought exclusively in the courts located in the country of the seller.

CHANGES TO TERMS AND CONDITIONS

We reserve the right to modify these Terms and Conditions at any time. Your continued use of our website or purchase of our Products following any such changes constitutes your acceptance of the new terms and conditions.

ENTIRE AGREEMENT

These Terms and Conditions, together with our Privacy Policy, constitute the entire agreement between you and iuliastration.com regarding the use of our website and the purchase, license, download, and use of our Products. Any prior agreements or understandings, whether oral or written, are superseded by these terms and conditions.

SEVERABILITY

If any provision or part thereof of the present general terms and conditions of use are not valid, they must be replaced with the contents that equals their meaning and purpose of the original. The validity of the other parts of the present general terms and conditions remain unchanged.
